If you do not agree with the results of an IRS decision on your case, you can appeal to a local IRS Appeals Office. The IRS Appeals Office is separate and independent of your local IRS office. A tax appeal will usually arise beyond the stage of auditing after the government has made a determination that you are not entitled to a deduction or that you have to pay the liability. At The Hammond Law Group, PLLC, we take a proactive approach to strategically defend your rights and appeal IRS decisions.

A timely approach for successful results in tax appeals and tax court
A timely written protest is required in most cases, which sets forth information to support your position. Our firm will begin an immediate investigation to collect all necessary documentation to challenge an IRS claim. We are experienced in tax audits and the organization of documents for individuals and businesses facing tax disputes.

Our attorneys will file a timely request for an appeal on your case. We will be prepared to discuss and argue all disputed issues with the appeals office. In most instances, if the agreement is not reached at your appeals conference, you can take your case to Tax Court to have a tax court judge review your case.

We are experienced in handling tax appeals involving:

The IRS may have to pay your legal fees if you win your appeal at Tax Court (before the tax judge). Our attorneys are experienced and qualified to practice in the U.S. Tax Court anywhere in the country, however, the tax court is a technically complicated environment that can become expensive for both parties. Our attorneys know that the IRS is interested in resolving a case before it goes to Tax Court and can effectively negotiate on your behalf.

Do I need an attorney to handle my appeal?

It is generally recommended that you retain an attorney to represent you in the appeals process because of the maximum protection of confidentiality that is only available through an attorney.

Sometimes the cost of an appeal may exceed the money you could save it is successful. We will explore your options and alternatives to the appeals process if an appeal is not cost-effective.
